How can I avoid a criminal conviction?

A common question asked by a lawyer is whether or not a conviction will be recorded for an offence. The answer to that query is possibly.

In Queensland, sentencing courts generally have a discretion as to whether or not a conviction is recorded against an individual facing criminal or traffic convictions so long as a term of imprisonment is not imposed. Given the discretionary nature of the principle, no lawyer could ever guarantee that an individual could not have a conviction recorded against them.  A good lawyer, however, will be able to give you advice to ensure that you have the best chance of ensuring that no conviction is recorded against you.

Section 12 of the Penalties and Sentences Act 1992 (Qld) contains the relevant considerations a court will have regard to in determining whether or not a conviction ought to be recorded against an individual. Those considerations include, but are not limited to the following:

  • The nature of the offence;
  • The offender’s character and age;
  • The impact a recorded conviction will have on social or economic wellbeing;
  • The impact a recorded conviction will have on an individual’s chances of finding employment.
